On January 29, 2008, TOUSA, Inc., et al., (collectively the "Debtors") filed voluntary petitions for reorganization under chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the Southern District of Florida (the "Court"). The Court ordered the Debtors' cases to be jointly administered under case number 08-10928 (JKO).
On February 13, 2008, the Office of the United States Trustee for the Southern District of Florida appointed an official committee of unsecured creditors (the "Creditors' Committee") in the Debtors' cases. The Court entered an order on March 25, 2008 appointing The Garden City Group, Inc. as the information agent for the Creditors' Committee.
On August 5, 2013, the Court entered an order confirming the Amended Joint Plan of Liquidation of TOUSA, Inc. and Its Affiliated Debtors and Debtors in Possession under Chapter 11 of the Bankruptcy Code (the "Plan") and on August 21, 2013, the Effective Date (as defined in the Plan) occurred.
