Long Beach Medical Center Case Information


On February 19, 2014, Long Beach Medical Center and Long Beach Memorial Nursing Home, Inc. d/b/a The Komanoff Center for Geriatric and Rehabilitative Medicine (together, the “Debtors”) each filed a voluntary petition for relief under Chapter 11 of Title 11 of the United States Bankruptcy Code (“Chapter 11 Cases”) in the United States Bankruptcy Court for the Eastern District of New York (Central Islip division) (“Bankruptcy Court”). The Chapter 11 Cases were assigned to the Honorable Alan S. Trust and are jointly administered, for procedural purposes only, under the main case, Long Beach Medical Center, Case No. 14-70593 (AST). On May 22, 2014, the Bankruptcy Court entered an order approving the sale of substantially all of the real and personal property assets, including the former hospital facility, of Long Beach Medical Center to South Nassau Communities Hospital [ECF Dkt. No. 184]. The closing of the sale was effective 12:01 a.m. on October 17, 2014 [ECF Dkt. No. 272].

On May 22, 2014, the Bankruptcy Court entered an order approving the sale of substantially all of the real and personal property assets, including the former nursing home facility, of Long Beach Memorial Nursing Home, Inc. to MLAP Acquisition I, LLC and MLAP Acquisition II, LLC [ECF Dkt. No. 185]. The Bankruptcy Court, as well as the New York State Department of Health, approved a receivership agreement pursuant to which MLAP Acquisition I, LLC was to serve as receiver for the nursing home pending the closing of the sale. The Receivership became effective on November 3, 2014 [ECF Dkt. No. 320]. The closing of the sale occurred on August 29, 2016. On August 23, 2017, the Bankruptcy Court confirmed the First Amended Joint Plan of Liquidation Under Chapter 11 of the Bankruptcy Code of Long Beach Medical Center, at al. (“Plan”) by entry of an order entitled “Findings of Facts, Conclusions of Law, and Order Confirming First Amended Joint Plan of Liquidation Under Chapter 11 of the Bankruptcy Code of Long Beach Medical Center, et al.” [ECF Dkt. No. 631] (“Confirmation Order”). The Plan became effective October 3, 2017 [ECF Dkt. No. 649]. Pursuant to the Plan and the Confirmation Order, Lori Lapin Jones, Esq. was appointed Plan Administrator for the post-confirmation estates of the Debtors.

The general bar date in these cases was April 25, 2014. The Chapter 11 administrative bar dates were October 19, 2016 and December 4, 2017. The Debtors’ estates were not substantively consolidated under the Plan.
