On May 24, 2011, Jackson Hewitt and its subsidiaries (the "Debtors") filed voluntary petitions for reorganization under Chapter 11 of the U.S. Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware (the “Court”). The Company has also agreed with 100% of its lenders, under its existing credit facility, on a prepackaged plan of reorganization that contains the terms of the balance sheet restructuring and filed this plan together with the petitions. Jackson Hewitt is using this legal process to reduce debt, obtain court approval of its plan and emerge quickly as a much more viable, financially healthy company.
On May 25, 2011, the Court entered an order authorizing the Debtor to retain The Garden City Group, Inc. as its noticing and balloting agent.
On May 24, 2011, the Debtors filed the Joint Prepackaged Plan of Reorganization of Jackson Hewitt Tax Service Inc. and Subsidiaries (the "Plan") and the accompanying Disclosure Statement (the "Disclosure Statement"). On August 5, 2011, the Debtors filed their Amended Joint Prepackaged Plan of Reorganization (the "Amended Plan"). On August 8, 2011, an Order was entered confirming the Debtors’ Amended Plan. On October 28, 2014, the Court entered an order terminating the employment of The Garden City Group, Inc.
