Fortunoff's Bankruptcy Filing

On February 5, 2009, Fortunoff Holdings, LLC and Fortunoff Card Company, LLC (collectively, "Fortunoff") filed voluntary petitions to reorganize under chapter 11 of the U.S. Bankruptcy Code (the "Cases") in the United States Bankruptcy Court for the Southern District of New York (the "Bankruptcy Court"). The bankruptcy cases are assigned to the Honorable Robert D. Drain, United States Bankruptcy Judge.

Conversion of the Cases to Chapter 7, the Appointment of a Trustee, and the Filing of Proofs of Claim

On October 1, 2009, the Bankruptcy Court entered an Order converting Fortunoff's Cases to Chapter 7. Soon thereafter, the United States Trustee appointed Ian J. Gazes as Chapter 7 Trustee and scheduled a meeting of creditors (the "creditors meeting") for November 10, 2009 at 2:00 P.M. at the Office of the United States Trustee, 80 Broad Street, Fourth Floor, New York, New York 10004-1408.

February 8, 2010 at 5:00 P.M. (Eastern Time) has been set as the last day to file a Proof of Claim for all creditors (except a governmental unit), and March 30, 2010 at 5:00 P.M. (Eastern Time) has been set as the last date to file a Proof of Claim for a governmental unit. To be paid, a creditor must file a Proof of Claim even if its claim is listed in the Schedules filed by the Debtors. IF A CREDITOR PREVIOUSLY FILED A PROOF OF CLAIM IN THE CHAPTER 11 PROCEEDING, IT DOES NOT HAVE TO FILE ANOTHER CLAIM.
