On October 5, 2015, American Apparel, Inc. and certain of its affiliates, (collectively, "American Apparel" or the "Debtors") filed voluntary petitions for relief under chapter 11 of title 11 of the United States Code (the "Chapter 11 Cases") in the United States Bankruptcy Court for the District of Delaware (the "Bankruptcy Court"). International subsidiaries were not included in the chapter 11 filing and will not be subject to the requirements of the U.S. Bankruptcy Code. American Apparel expects U.S. and international operations will continue without interruption during the restructuring process.

From November 30, 2015 through January 7, 2016, the Debtors conducted the solicitation of their Joint Plan of Reorganization (the “Plan”). The Plan was approved by the United States Bankruptcy Court for the District of Delaware (the “Court”) on January 25, 2016. On January 27, 2016, the Court entered the Findings of Fact, Conclusions of Law and Order Confirming the First Amended Joint Plan of Reorganization of the Debtors and Debtors in Possession of American Apparel, Inc. (Docket No. 687). The Plan became Effective on February 5, 2016 (See Docket No. 722). The Debtors have emerged from Chapter 11 bankruptcy protection as a new private company, American Apparel, LLC.
